Stevens, J. —
I. The grand jury of Decatur County, on August 5, 1921, returned an indictment against appellant, jointly charging him and one Roy Dillon with the theft of a Dodge automobile from John Hardin, who resided near Line-ville in that county. Appellant was given a separate trial, as the result of which he was convicted and sentenced- to an indeterminate term of not to exceed five years in the state reformatory at Anamosa.
