This matter is before the Court on Defendants’ Motion to Dismiss (Doc. # 14) and Defendant M & I Bank’s Motion to Dismiss on Additional Grounds (Doc. # 15). This lawsuit stems from Plaintiffs Alan C. and Deborah Ivar and Clifford A. Bernstein’s purchase of undeveloped lots in a subdivision of Steamboat Springs, Colorado.
