The appeal herein arises from an order granting the Plaintiffs Motion for Summary Judgment against the Defendant on the issue of liability.

On September 15, 1972, the Plaintiff-Respondent, G-H Insurance Agency, Inc. (The Agency) entered into a contract with the Defendant-Appellant, Continental Insurance Company (Insurance Company), under the terms of which The Agency would receive and accept proposals for insurance to be written by the Insurance Company.
