DECISION ON MOTIONS FOR SUMMARY JUDGMENT
BURTON PERLMAN, Chief Judge.
Plain tiff/trustee in his first amended complaint seeks to sell “a certain water craft” free and clear of liens pursuant to 11 U.S.C. § 542 and § 543. In his complaint, he also seeks turnover of money from a sale conducted prior to the bankruptcy filing. Thirdly, he seeks avoidance of a preference. The water craft has now been sold, and entitlements with respect to the proceeds are now at issue.
