MEMORANDUM — DECISION AND ORDER

MUNSON, Senior District Judge.

Currently before the court is defendants’ motion for summary judgment, pursuant to Rule 56 of the Federal Rules of Civil Procedure. For the reasons that follow below, defendants’ motion is GRANTED.

BACKGROUND

The relevant facts are undisputed. On April 29, 1997, plaintiff Mary Anne Kilmer, a resident of the State of New York, and defendant Philip Staples, a resident of the State of Maine, were involved in an automobile accident in Orlando, Florida.
