STEWART, Justice.
Michael Sullemon brought a workers’ compensation case against United States Fidelity & Guaranty Company (Fidelity) for benefits from injuries sustained by Sullem-on while in the course and scope of his employment. The jury found that Sullem-on was injured in the course of his employment and that such injury was a producing cause of total temporary incapacity and not, as Sullemon alleged, total and permanent incapacity.
