CROSS, District Judge.

The libel in this action is filed to recover damages to steam dredge No. 2, belonging to libelant, which resulted *167from a collision between it and a tow in charge of the tug Norwich belonging to the respondent. The accident happened on the 19th of May, 1897, at about 11 o’clock in the evening, at a place known as “Mull’s Rock,” in the Hudson river between Coxackie and the state dam at Troy. The libelant had a contract with the United States government for the removal of sand and rock which obstructed navigation at the place above mentioned. He had been engaged iii the…
