The facts of this case are not in dispute and are thus set forth in the complaint: Julius P. Heil was elected governor on November 5, 1940, for a term beginning the first Monday in January, 1941. He duly qualified for the office and has since been, and is now, the duly elected and qualified governor. Walter S. Goodland, at the same election, was elected to the office of lieutenant governor, qualified for the office, and is now the duly elected and qualified lieutenant governor.
