This is a suit to cancel an assessment and to en jo-in the collection of taxes based thereon. From a judgment in favor of plaintiff, defendant has appealed. The case was tried and decided upon the following agreed statement of facts, to wit;

“The plaintiff, the White Oil Corporation,' is a corporation orpamigprl nnrl existing under the laws of the state oiDelaware. and on January 1, 1921,"maintained its principal business establishment and offices at No. 06 Broad street, New York City; its present chief place of business and principal offices are located in the Binz Building, Houston, Tex.
