Error to recorder’s court of Detroit; Heston (William M.), J. Joseph Kongeal was convicted of an assault with intent to commit the crime of statutory rape, and sentenced to imprisonment for not less than 5 nor more than 10 years in the State prison at Jackson.

Defendant was tried and convicted by the verdict of a jury in the recorder’s court of the city of Detroit of the crime of assault with intent to com*310mit rape upon Margaret Boiey, a female child under the age of consent, in violation of section 15212, 3 Comp. Laws 1915, and sentenced to confinement in the State prison at Jackson for a period not exceeding 10 years.
