Tbe question for our determination is tbe validity of tbe following ordinance:

“SectioN 1. That it shall be unlawful for any person, firm or corporation to install, build, construct or erect, alter or repair any building, place or structure to be used as what is commonly known as a gasoline service station where gasoline and oils are kept and sold, nearer to any dwelling than 250 feet, within tbe corporate limits of tbe city of Fay-etteville, provided that this ordinance shall not apply to service stations already established, and to tbe erection of any stations where a permit has already been…
