This action was begun in the superior court of Tulsa county by H. P. Porter, defendant in error, hereinafter called plaintiff, against Robert Shipman and David Shipman, plaintiffs in error, hereafter called defendants, to recover upon a promissory note. Thereafter the cause was transferred to the district court of said county.

Plaintiff alleges in his petition that said note was-executed to Mrs. Vera Porter by defendants and indorsed by her before maturity, without recourse, and that said note was delivered to said plaintiff, and that plaintiff is now the owner and holder…
