The defendant in error, Curtis Powell, was plaintiff in the trial court, and will be hereinafter referred to as the plaintiff. The plaintiff in error was defendant in the trial court, and will be hereinafter referred to as the defendant.

The notice of motion was originally instituted against the Chesapeake and Qhio Railway Company for dam-, ages sustained by the plaintiff on February 2, 1918, because of alleged negligence on the part of the said company when it was under Federal control.
