’ This was an action by Harry Carlton Roberts against the Southern Railway Company for injuries sustained by him in the falling of a highway bridge. There was a verdict by the jury for ten thousand dollars ($10,000.00) in favor of the plaintiff against the defendant, which upon the motion that the verdict was contrary to *820the law and the evidence and without evidence to support it, was set aside by the court, and judgment entered for the defendant. To this action of the court the plaintiff excepted, and for alleged error in this ruling as well as error in the refusal to give his instruction…
