This is an appeal from a judgment entered on a finding that the appellant was guilty of obtaining credit in the amount of $125.00 by means of a fraudulent check as charged in an amended affidavit, for which he was sentenced to the Indiana State Prison for a term not less than one nor more than ten years. The error assigned here is the overruling of appellant’s motion for a new trial, which assigned as causes therefor (1) the finding of the court was contrary to law, and (2) the finding of the court was not sustained by sufficient evidence.
