The appellant was charged with the offense of burglary as defined by § 10-701, Burns’ 1942 Replacement (Acts of 1929, ch. 54, § 2, p. 136; 1935, ch. 212, § 1, p. 1017; 1941, ch. 148, § 4, p. 447) After trial by jury and verdict of guilty, the judgment of conviction sentenced him to imprisonment in the state prison for a term not less than ten years nor more than twenty years, and disfranchised him for a period of ten years.
