Kerry P. Clancy (“plaintiff’) contracted with Onslow County Behavioral Healthcare Services (“BHS”), the mental health area authority for Onslow County, for plaintiff to provide treatment and care to disabled clients in his home. On or about 26 April 2000, Onslow County Department of Social Services (“DSS”) received a complaint that one of plaintiffs clients, Lewis Simmons (“Simmons”), had an injury on the left side of his face.
