MEMORANDUM OPINION AND ORDER

NORDBERG, District Judge.

The plaintiffs instituted this action pursuant to 42 U.S.C. § 1983 to contest the Commissioner of the Department of Consumer Services of the City of Chicago’s (“the Commissioner”) unilateral imposition of a moratorium on the transfer of taxicab licenses. 1 Plaintiffs Checker Cab Co. (“Checker”) and Yellow Cab Co. (“Yellow”) have filed a motion for summary judgment with respect to Count I of their three-count amended complaint.
