Marion Ciulla brought this action seeking benefits under a group long-term disability policy that USAble Life issued to Ciulla’s former employer. The policy is an employee benefit plan as defined by the Employee Retirement Income Security Act of 1974 (ERISA), 29 U.S.C. §§ 1001-1461. The issue is whether the plaintiff was disabled within the meaning of the policy on the last day of his employment, which is when his coverage under the defendant’s policy ended.
