DENTON, Chief Justice.

This is a summary judgment case. I. & H. Development Company brought suit against James Womack and Wayne Whit-son on four promissory notes. The defendants answered by general denial and a verified plea of partial payment. The trial court granted plaintiff’s motion for summary judgment and the defendants have perfected this appeal.

Appellee filed its unsworn petition alleging the execution and delivery of four promissory notes, each in the principal sum of $1300.00, dated September 8, September 25, October 7 and December 7, 1964, respectively. Each note was due ninety (90)…
