Plaintiff seeks to recover upon a policy of fire insurance for $4,800.00 issued to ber on a stock of goods situated in Redelm, S. D., claiming that while said goods were insured and on April 12, 1930, they were totally destroyed by fire and that at said time they were worth the value of $7,670.00, that she “duly fulfilled all the conditions of said insurance on her part,” giving to the defendant “due notice and proof of the fire, and loss aforesaid, as required by said policy;” that the defendant took the position at all times that it was not liable on said policy, refused to pay and “waived…
