This is an appeal from a judgment in favor of the plaintiff and an order of the district court of Traill county denying defendant’s motion for a new trial. The action was brought to recover damages for breach of an express contract of *188warranty, alleged to have been made by defendants upon the sale to the, plaintiff of a- certain gray mare.
