Plaintiff appeals as of right an order of the circuit court dismissing with prejudice his complaint for specific performance of an alleged contract to buy and sell land.'We reverse and remand.

The property at issue is located at 9457 Dixie Highway in Springfield Township, Oakland County, Michigan. On November 4, 1994, plaintiff submitted an offer to purchase the subject property for the sum of $360,000, with $125,000 down and the balance to be paid on a five-year land contract.
