This is an action filed by plaintiff Stuart Brace against his employers, the Ohio State University (“the University”) and the Ohio State University Medical Center (“the Medical Center”), and against John M. Riddles and Soradej Thimdit, employees of the University. This matter is before the court on the motion of defendants to dismiss Counts III, VI, VII and VIII of the complaint pursuant to Fed.R.Civ.P. 12(b)(6) for failure to state a claim upon which relief may be granted.
