PICKETT, Circuit Judge.
This action was brought by Martha Cramer Lewis, Guardian of Richard Fields, a five-year-old child, and Dennis Fields and Joan Fields, parents of the child, against H. Leo Owen, a physician in Bartlesville, Oklahoma, to recover damages alleged to have resulted from the failure to properly diagnose and treat the child for a disease which caused him to be mentally retarded.
