The parties will be referred to as they appeared in the trial court, inverse to the order here. Ira T. Foster sued the First National Bank of Oklahoma City, herein referred to as the bank, to recover a note for $3,400, and a mortgage, the latter securing the former on real estate in Garvin county, Okla.— praying, in the alternative, that if such. recovery be refused the court require an accounting .by defendant of all property in its hands belonging to the Aurelius-Swanson Company, Inc., herein called the company ; that on such accounting the defendant be required fir^t to…
