ORDER ADOPTING IN PART MAGISTRATE JUDGE’S REPORT AND RECOMMENDATION
FONG, District Judge.
INTRODUCTION
On April 7, 1992, the magistrate judge filed a Report and Recommendation that defendants’ motion for summary judgment be granted and the complaint be dismissed. On April 15, 1992, plaintiff Mujahid filed objections to the Report and Recommendation. On April 17, 1992, defendants also filed objections to the Report and Recommendation. On May 1, 1992, plaintiff Mu-jahid filed a “reply” memorandum to defendants’ objections.
