I. INTRODUCTION
Brett Johnson (“plaintiff”) brings this class action on behalf of himself and all others similarly situated against Wave Comm GR LLC (“Wave Comm”), and its two owners, Robert Guillerault (“Guiller-ault”) and Richard Ruzzo (“Ruzzo”) (collectively “defendants”) alleging violations of the Fair Labor Standards Act, as amended, 29 U.S.C. §§ 201-219 (“FLSA”) and New York Labor Law (“NYLL”), N.Y.
