IRVING R. KAUFMAN, Circuit Judge:

Title VII of the Civil Rights Act of 19641 was enacted by Congress to eradicate employment discrimination based on race. Enforcement of the statute’s provisions was widespread and effective in the 1960’s and 70’s and resulted in dramatic improvements in the unbiased treatment of nonwhite employees and job applicants.
