Plaintiffs H-D Michigan, LLC (“HDM”) and Hariey-Davidson Motor Company, Inc. (“HDMC”) brought the instant action asserting claims of trademark infringement, false designation of origin, unfair competition and trademark dilution pursuant to 15 U.S.C. §§ 1114(a), 1125(a), 1125(c), similar common law claims, and breach of contract. In its Answer Defendant Sovie’s Cycle Shop, Inc. (“Sovie’s”) asserted counterclaims for breach of contract and violations of the New York Franchised Motor Vehicle Dealer Act, N.Y. Veh. & Traf.
