WYATT, District Judge.
This is a motion by plaintiff for summary judgment “interlocutory in character” on the issue of liability alone, as authorized by Rule 56(c) of the Federal Rules of Civil Procedure.
Time Incorporated (Time Inc.), the plaintiff, is a corporation which, among other things, publishes “Life”, “Time” and “Fortune” magazines; it also publishes books; and it has “Broadcast divisions” (Hardy affidavit, p. 7), the operations of which are not explained but presumably involve radio or television broadcasting or both.
