This case requires us to determine the standard for discovery of loss for purposes of notice under a fidelity policy. Gulf USA Corporation (“Gulf’) sued Federal Insurance Company (“Federal”), seeking a declaratory judgment that Federal breached its obligations under the employee theft coverage clause of Crime Policy No. 80948166-D (“Crime Policy”).
