Appeal from order denying defendant’s blended motion for judgment non obstante or a new trial.

Plaintiff, as special administrator, brought this action to recover damages for the wrongful death of his minor son, seven years old, who died July 17, 1946, from drowning in a small boat harbor built and maintained by defendant on a triangular-shaped point of land jutting out into Lake Pepin.
