Appeal from IAnn District Court. — Milo P. Smith, Judge. The action is for damages, actual and exemplary, for assault and battery. There was a trial to a jury, and a verdict and judgment for plaintiff in the sum of $1,500. Defendant appeals.

Several errors are assigned, but these relate to the one question, and that is in regard to the alleged provocation to defendant, and whether the evidence offered in reference thereto *905should have been admitted and received on the question of mitigation of damages. ¡
