On May 8, 1935, the defendants for a valuable consideration executed and delivered to the defendant The Federal Land Bank of Omaha their promissory note for $3,800, with interest, and secured the payment of the note by executing and delivering a mortgage on two quarter sections of land owned by them in Brown County. At the time of the commencement of this action on April 22, 1938, defendants were in default in the payment of the first five semi-annual installments and had failed to pay taxes for the years 1934 to 1937.
