This action was instituted by the appellants, as assignees of a certain contract for the purchase of real estate located in the city of Butte. The only question arising is as to the sufficiency of the complaint, raised at the trial of the ease after issue joined and a jury had been impaneled and sworn, by objection to the introduction of any evidence in support of either the first or second cause of action, for the reason that each fails to state facts sufficient to constitute a cause of action. • The trial court sustained the objection and entered judgment in favor of respondent.
