OPINION

SWEET, District Judge.

Defendants Police Officer Tuozzolo (“Tu-ozzolo”), P.O. Applewhite (“Applewhite”), Sgt. Chu (“Chu”), Sgt. Dempsey (“Dempsey”), Sgt. Anderson (“Anderson”), Sgt. McKernan (“McKernan”) (collectively, the “individual defendants”) and the City of New York (“the City”) have moved for partial summary judgment pursuant to Fed.R.Civ.P. 56. Plaintiff Frank Standt (“Standt”) opposes. For the reasons set forth below, the motion will be granted in part and denied in part.
