KEITH, Justice.

The defendant appeals from an adverse judgment rendered in a suit for false imprisonment where the jury returned a verdict which included both actual and exemplary damages. We will designate the parties as they appeared in the trial court.

Plaintiff was accompanied to defendant’s store by Charlotte Taylor, a known shoplifter; but, when the two reached the store, according to plaintiff, she went to the rear and made a payment upon some merchandise which she had in lay-away.
