Appeal from a judgment of the superior court for King county, Humphries, J., entered May 22, 1913, upon the verdict of a jury rendered in favor of the defendant, in an action in tort.

The plaintiffs brought this action to recover damages alleged to have been sustained to their property *572by reason of the negligent regrading of Fifth avenue in the city of Seattle. The cause was tried to the court and a jury. A verdict was rendered in favor of the defendant. After a motion for new trial had been denied, judgment was rendered upon the verdict. This appeal followed.

The appellants are the owners of two lots, at the corner of Fifth avenue and Yesler Way, in the city of Seattle. Yesler Way runs in an easterly and westerly direction, and has an established grade of about fifteen per…
