On July 3, 2012, a grand jury returned an indictment charging Eric Jacobson (“Jacobson” or “defendant”) with one count of conspiracy to distribute a controlled substance (oxycodone) in violation of 21 U.S.C. § 846, and five counts of distribution of a controlled substance (oxy-codone) in violation of 21 U.S.C. § 841(a)(1).
