THURMOND CLARKE, District Judge.

By this action in the nature of inter-pleader, plaintiff insurance company asks this court to determine whether a portion of the proceeds of a policy of life insurance should be paid to the widow of the insured or to the estate of the former wife of the insured. Defendants are the executrix and sole legatee under the will of the first wife, and the second wife individually and as executrix of the husband’s will.
