By the information it is charged that the defendant, a deputy treasurer of Salt Lake county, on July 23, 1923, unlawfully and feloniously appropriated $200, property of Salt Lake county, to his own use, contrary to chapter 39, § 8235, Comp. Laws Utah 1917, relating to “Crimes against Public Property.” In support of the charge the evidence of the state was directed to a transaction in which one Chamberlain, at about the time stated in the information, paid to the defendant $392 to redeem certain property from a tax sale, and the giving of a receipt by the defendant showing the…
