Plaintiff in error, hereinafter called defendant, was convicted in the district court of Oklahoma county of the crime of forgery in the second degree, and his punishment fixed by the jury at imprisonment in the state penitentiary for a period of six years.
The evidence of the state was that on the 24th day of February, 1931, defendant, under the name of E. O.
