DAVIDSON, Presiding Judge.

Appellant shot and killed Ed Cantrill in the town of Saratoga, in Hardin County, for which the jury allotted him a term of five years in the penitentiary for manslaughter.

The facts disclose that appellant and deceased had been intimate friends for quite a number of years, and also discloses several acts of friendship on the part of appellant towards deceased in getting him employment at different times.
