HAWKINS, Judge.
— Appellant Appellant is under conviction for murder of Sam Tonnahill with punishment of five years in the penitentiary.
The killing occurred in April, 1921 at a school entertainment." The State's evidence indicated that appellant shot deceased at a time when the latter was unaware of appellant’s presence; that the shots all entered the rear portion of the body, some being fired after deceased had fallen.
