HARPER, Judge.

Appellant was prosecuted and convicted of murder in the second degree, and his punishment assessed at fifteen years confinement in the penitentiary.

This case was tried in 1911, and for more than two years the record was not filed-in this court, and when filed no statement of facts aceom panied it, but appellant’s counsel filed an affidavit stating that he had secured the approval of and filed a statement of facts within the time provided by law, and asked that this court postpone consideration of the case until the statement of facts could be substituted.
