This is an appeal from a judgment entered by the Municipal Court of Athens, Ohio, upon a plea of “no contest,” finding Vernon Brite, defendant below and appellant herein, guilty of operating a motor vehicle while the alcohol concentra tion in his body was in excess of ten-hundredths of one gram per two hundred ten liters of breath as proscribed by R.C. 4511.19(A)(3). The following error is assigned for our review:
