MEMORANDUM OPINION AND ORDER

In this environmental cleanup litigation, the court addresses the parties’ motions for partial summary judgment concerning certain of plaintiff-counterdefendant’s state-law claims and one of defendantcounterplaintiffs state-law counterclaims. As with other motions that the court has decided in this case, some of the questions presented involve issues of nascent law. For the reasons that follow, the court grants in part and denies in part both parties’ motions.
