BELL, Chief Justice.
This is an election contest. The appellant was certified by the Democratic Executive Committee of Brazoria County as the Democratic nominee for County Commissioner, Precinct 3, of Brazoria County, the certification resulting from a determination by the committee that he had won the run-off primary as he received 1,365 votes to 1,362 votes for appellee, Henry Jordan. Appellee, on June 11, 1960, filed his petition in the District Court contesting the election, the basis of the contest being the illegality of various votes.
