HOUSER, Commissioner.
Action by William P. and Clothilda Kim-brough to recover from Bernard A. Gross, d/b/a Bernard A. Gross Real Estate Company, the sum of $500 deposited with the latter under an earnest money contract for the sale of certain real estate in the City of St. Louis.
The petition named the owners of the real estate and alleged that defendant broker was their agent; the execution on July 17, 1950 of a written earnest money contract between plaintiffs, the owners and defendant, for the sale of the real estate; the deposit by plaintiffs with defendant of the sum of $500 as earnest…
